Guest agreement

1. The Booking

Your booking is with Arcdewan properties (Trading as Arcdewan Ltd in these terms and conditions), which is a Limited Company, registered in England and Wales, 13095528, International House, 64 Nile Street, London, N1 7SR.

1.1. References to you or your guests are references to the person or organisation making the booking with Arcdewan Properties.
1.2. These terms apply to bookings made via Arcdewan Properties, either via their website, email, telephone or in-person. Bookings made via Booking.com, Air BnB and Expedia will be subject to their terms and conditions and additionally our own terms noted here.
1.3. Your booking will only be confirmed once all payments have been successfully made and only then does your booking become a legal contract. No booking is made or contract concluded when payment is declined, unauthorised or partly processed.
1.4. You agree that the booking is for a short term stay for leisure, business or temporary purposes and does not give rise to an assured shorthold tenancy or lease and is an excluded agreement within the meaning of s.3A(7)(a) of the Protection from Eviction Act 1977.
1.5. Bookings can be for any length from one night up to three months. Bookings may be made any time up to 18:00hrs on the first night of your stay. All documents and payments have to be promptly made for last minute bookings to ensure a swift check in, taking into consideration paragraph 1.3 above. Proof of ID should be sent through within 48hrs of your booking confirmation, failure to which your reservation could be cancelled.
1.6. Bookings may only be made by a person aged 25 or above and there must be at least one person aged 25 or above staying in the accommodation for the entire duration of the booking.
1.7. You may not re-sell or reassign your booking to any other person or organisation except with the express authority of Arcdewan Properties Ltd management.

2. Payment and Cancellations

2.1. All payments shall be made by a Credit or Debit Card either directly to Arcdewan properties or via the booking engine. Arcdewan Properties do not directly charge booking fees, credit or debit card fees.
2.2. Full payment is required before proceeding to the property and not later than 14 days prior to arrival for longer stays unless expressly agreed otherwise by Arcdewan Properties Management team.
2.3. The total price for your entire stay will be presented to you before you confirm your booking and make payment. Our pricing is dynamic and therefore the price for the same or similar accommodation may vary over time after your booking is made. This does not confer upon Arcdewan Ltd any right to require additional payment where the price increases and does not confer any right on you to a discount if the price decreases.
2.4. Both Arcdewan Properties and you may cancel the booking at any time up to 14 days prior to the first day of your booking with Arcdewan Properties in which case a full refund will be made to you. After this period, the total amount will be payable. If booking via an OTA, then the terms of that OTA take precedence.
2.5. If you cancel the booking within 14 days leading to your stay, then Arcdewan Properties reserves the right to retain the full amount paid. Any refund will be at Arcdewan Properties’ entire discretion. If the accommodation is subsequently booked by other guests during the same period then a refund to you of your booking cost, less any difference in price where the replacement booking was of a lesser value, will be issued back to you.
2.6. Arcdewan Properties reserves the right to cancel bookings within 7 days leading to the first day of the reservation if necessary. This could be due to reasons outside of Arcdewan Properties’ reasonable control or in the event of an overbooking resultant from the booking system errors or system delays. In the event of such a cancellation, the client will receive a full refund from Arcdewan Properties.
2.7. A Late check-out fee of £50 per hour will be charged where a late check out has not been pre-authorised.
2.8. Where the maximum / unauthorised guests’ occupancy of the accommodation is exceeded, a penalty charge of £300 or more will be payable.

3. Your Stay

3.1. Check-in time is from 16:00hrs and check-out time is to be no later than 10:00hrs unless expressly agreed by Arcdewan Properties. Arcdewan Properties may request an additional payment for either early check-in or later check-out.
3.2. Arcdewan Properties only provides Serviced Accommodation and not hotel or guest house service. In addition, Arcdewan Properties does not provide meals or newspapers.
3.3. Included in your accommodation will be linen, towels and shower gel. Cleaning service is also provided upon check out or as arranged with Arcdewan management on check in if guest/s has/have booked a longer stay.
3.4. Your accommodation will also include a supply of basics like coffee, tea and sugar.
3.5. You as the booker are responsible for the conduct of all guests staying within the accommodation and shall ensure that they comply with these terms and conditions. In particular, you and your guests must not:
– Smoke in the premises.
– Bring any pets into the premises, with the exception of assistance dogs which must be declared prior to booking.
– Bring any potentially dangerous or hazardous materials or equipment onto the premises.
– Tamper with any fire alarms or emergency equipment.
– Remove, damage, move or destroy any property within the premises.
– Use any technology provided by Arcdewan Properties to download or access any unlawful or obscene material.
– Cause unreasonable disturbance to other residents, be violent to Arcdewan management or other residents.
– Make excessive noise at any time of the day, in particular after 23:00hrs.
– Fail to return your accommodation keys/fobs/cards at the end of your stay.
– Engage in drugs or any illegal activities.
– Allow unbooked guests to stay in the property.

4. Damage, Theft and Costs

4.1. Arcdewan Properties reserves the right to charge to the credit/debit card used for payment in respect of:
– Replacing or repairing any property damaged during your stay.
– Replacing stolen property during your stay.
– Breach of non-smoking policy (£200 standard charge).
– Time spent repairing/replacing damaged items (£50 standard charge).
– Noise complaints (up to £1000 charge).
4.2. Such costs may be charged upon check-out or later.
4.3. If Arcdewan Properties cannot charge your card, an invoice will be issued payable within 14 days.
4.4. A receipt with breakdown of costs will be provided.
4.5. Breach of house rules may lead to forfeiture of deposit and immediate eviction.
4.6. No refunds will be made if you are evicted for misconduct.

5. Privacy, Data Protection and Security

5.1. Arcdewan Properties processes personal information in accordance with its policies.
5.2. By law, guest names and nationality must be recorded and kept for at least 12 months. Non-British/Irish/Commonwealth guests must provide passport/travel documentation.

6. Complaints

6.1. Arcdewan Properties wants to ensure an enjoyable stay.
6.2. Please raise issues with management for informal resolution.
6.3. Formal complaints may be submitted by email with full details.
6.4. Response aimed within 3 days; outcomes provided in writing.
6.5. Vexatious complaints may be rejected.

7. Limitation of Liability

7.1. Liability limited to total booking value except in cases of negligence.
7.2. Arcdewan is not liable for consequential or indirect loss.
7.3. Arcdewan is not liable for damages caused by force majeure, natural disasters, strikes, terrorism, or government actions.
7.4. Liability for death, personal injury or fraud is not limited.

8. Severability

8.1. If any provision is invalid, the remainder shall remain valid.

9. Waiver

9.1. Failure to enforce a right does not waive it. Waivers must be in writing.

10. Entire Agreement

10.1. These terms constitute the entire agreement between parties.

11. Third Party Rights

11.1. No rights are conferred on third parties unless expressly stated.

12. Jurisdiction

12.1. This Agreement shall be construed in accordance with English Law and subject to the Courts of England and Wales.
